Welcome to Mobile Facial Spa™ (“Mobile Facial Spa,” “MFS,” “we,” “us,” or “our”). These Terms & Conditions govern your access to and use of MobileFacialSpa.com, participating provider microsites and subdomains, booking and account features, provider-network services, and other related digital services (collectively, the “Platform”).
These Terms apply to customers who request or book services (“Clients”), independent beauty and skincare professionals participating in the Mobile Facial Spa™ Provider Network (“Providers”), and other users of the Platform.
By accessing the Platform, creating an account, submitting an application, or booking a service, you agree to these Terms.
1. About Mobile Facial Spa™
Mobile Facial Spa™ operates a technology-enabled mobile beauty and skincare network that helps Clients discover, verify, and book participating independent professionals.
MFS may provide centralized booking technology, provider profiles and microsites, verification features, service standards, branded resources, training or protocol requirements, payment-processing integrations, and other tools supporting the Mobile Facial Spa™ network.
Independent Providers
Unless expressly stated otherwise, participating Providers operate as independent professionals or independent businesses and are not employees of Mobile Facial Spa™.
Providers are responsible for maintaining their own professional qualifications, licenses, insurance, tax obligations, equipment, transportation, and other business requirements applicable to their activities.
Participation in the MFS network, compliance with MFS service standards, use of MFS technology, or authorization to offer particular MFS services does not by itself create an employer-employee relationship.
2. Professional Licensing and Legal Compliance
Providers must maintain all licenses, registrations, permits, certifications, insurance, and other qualifications required for the services they perform.
Providers are responsible for understanding and complying with the laws and professional rules applicable to them, including requirements imposed by state licensing boards and applicable federal, state, and local authorities.
Authorization by Mobile Facial Spa™ to display or offer a service through the Platform does not authorize a Provider to perform a service where that service would otherwise be prohibited by law or outside the Provider's professional scope of practice.
MFS may suspend, restrict, or terminate a Provider's access to particular services or to the Provider Network if licensing, insurance, qualification, safety, or compliance requirements are not satisfied.
3. MFS Verified Provider Status
Approved Providers may receive an MFS Verified Provider designation and may be provided with digital or physical identification containing a QR code linked to an MFS verification page.
Verification may include review of professional licensing information, identification, insurance, credentials, professional work evidence, training status, or other information required by MFS.
Verification means MFS reviewed the applicable information according to its verification procedures at the relevant time. It is not a guarantee of a Provider's future conduct, treatment outcome, or continuous license status.
Providers must promptly notify MFS of material changes affecting their eligibility. MFS may periodically require reverification.
4. Service Authorization
Not every Provider is automatically authorized to offer every service displayed by Mobile Facial Spa™. Services may require professional work verification, MFS protocol education or verification, device authorization, specialized training, or MFS certification.
Certain signature services, including designated HydroLift™ services, may require specific MFS certification before they can be offered through the Platform.
MFS may add, remove, restrict, or modify a Provider's service authorization based on credentials, training, qualification status, safety considerations, quality requirements, or changes in applicable law.
5. Booking and Mobile Service Locations
Services may be provided at eligible locations permitted by applicable law and MFS policies. Clients are responsible for providing a complete and accurate service address, appropriate access instructions, and a reasonably safe and suitable environment.
Providers may decline to begin or may discontinue an appointment when they reasonably determine that circumstances are unsafe, threatening, harassing, illegal, unsanitary, or professionally unsuitable. Financial outcomes will be determined under applicable MFS policies.
6. Booking Minimums
Standard individual mobile appointments may require a minimum eligible service purchase of $65.
Certain group, event, facility, corporate, or coordinated programs may have different minimums and separate terms. Where applicable, MFS group or event programs may require a $300 minimum.
7. Cancellations, Rescheduling and No-Shows
Unless different terms are disclosed for a particular program or booking, cancellations or rescheduling made at least 24 hours before the scheduled appointment generally do not incur a cancellation penalty.
Cancellations made less than 24 hours before the appointment may result in a charge of up to 50% of the scheduled service total. Confirmed no-shows may be charged up to 100%.
Clients generally receive a 15-minute grace period, but a late arrival does not require the Provider to extend the appointment beyond its scheduled ending time.
If a Provider cancels, the Client will not be assessed a customer cancellation penalty. Depending on the circumstances, MFS may assist with rescheduling, another available MFS Verified Provider, account credit, or an applicable refund.
8. Contraindications and Client Safety
Beauty and skincare services may not be appropriate for every person. Clients are responsible for providing accurate information concerning relevant allergies, medications, sensitivities, recent procedures, medical conditions, pregnancy where relevant, and other information reasonably necessary to evaluate potential contraindications.
Providers may modify, postpone, substitute, or decline a service when professional judgment or applicable rules indicate that proceeding would be inappropriate. The Platform does not provide medical diagnosis or medical treatment.
9. Prices and Payments
Prices may vary according to service, Provider, location, enhancements, travel requirements, programs, promotions, or other disclosed factors. Payments may be processed through third-party payment processors.
MFS does not intend to store complete payment-card numbers when those credentials are collected and maintained by the applicable payment processor.
Providers may be subject to network fees, platform fees, subscription fees, transaction fees, revenue-sharing arrangements, or other charges established in their separate Provider Agreement.
10. Off-Platform Transactions
Where a Client and Provider are introduced or connected through Mobile Facial Spa™, users may not intentionally circumvent the Platform to avoid applicable MFS booking, platform, network, or transaction requirements. Repeated or intentional circumvention may result in account restrictions or termination.
11. Provider Microsites and Content
MFS may provide participating Providers with individual profiles, pages, subdomains, booking links, QR verification pages, portfolios, or other digital features.
Providers are responsible for ensuring submitted information is accurate and that they have the legal right to use submitted photographs, videos, logos, portfolio materials, and other content. MFS may remove content that violates these Terms, applicable law, intellectual-property rights, professional requirements, or MFS standards.
12. Intellectual Property
The Mobile Facial Spa™ name, branding, logos, graphics, website designs, service names, training materials, protocols, verification badges, and other proprietary materials are owned by or licensed to Mobile Facial Spa™ and may be protected by intellectual-property laws.
Participation in the Provider Network does not transfer ownership of MFS intellectual property to a Provider. Authorized Providers may use approved MFS materials only in accordance with applicable Provider Agreements and brand guidelines.
13. Disclaimer of Results
Individual skincare and beauty-service results vary. MFS and participating Providers do not guarantee a particular cosmetic result, duration of result, or individual response to a service or product. Nothing presented through the Platform should be interpreted as medical advice.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Mobile Facial Spa™ will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Platform or services arranged through it.
Nothing in these Terms is intended to exclude or restrict liability that cannot legally be excluded or restricted. Additional limitations applicable to Providers may be established in the separate Provider Agreement.
15. Indemnification
To the extent permitted by applicable law, users agree to indemnify and hold harmless Mobile Facial Spa™ and its applicable owners, officers, employees, affiliates, and representatives from third-party claims, losses, liabilities, and reasonable expenses arising from the user's violation of these Terms, applicable law, another person's rights, or wrongful acts or omissions.
16. Account Suspension or Termination
MFS may restrict, suspend, or terminate access to the Platform when reasonably necessary because of fraud, nonpayment, safety concerns, misuse, licensing or credential issues, violation of these Terms or applicable law, or conduct materially harmful to Clients, Providers, MFS, or the integrity of the network.
17. Changes to These Terms
MFS may revise these Terms as the Platform, services, or applicable legal requirements change. The current version and effective date will be posted on MobileFacialSpa.com. Where legally required, additional notice will be provided.
18. Governing Law
These Terms are governed by applicable federal law and the laws of the state identified in Mobile Facial Spa™'s final corporate legal documentation, without regard to conflict-of-law principles.
